National Parks are about History as well. Drakes is a part of the area's History. Would they rather have natural oyster beds ripped up for production? I'm so sick of this extreme environmentalism. If they force him to close his oyster farm they must pay him it's entire value as a commercial business. It existed before the park. It existed before the Federal Government confiscated the land to make it a National Park. He is well covered by the 5th Amendment to the Constitution of the United States, which in it states "nor shall private property be taken for public use, without just compensation."

It does not apply to this case. This is clearly a government entity taking a business away from a private entity. Kelo was a decision that revolved around a private entity getting the condemned land for development. In other words, the land was condemned so it could be purchased and developed by a private entity. So, the courts claimed that it was not a government taking of private property and was there fore Constitutional.
This is clearly the Government taking of his business by refusing to renew the lease when they have the authority to do so.
It is also a very good example of why we should not have ever allowed the Federal Government to create the Park System. Though we all want the parks, it would have been best to allow the states to tax their own people and maintain possession of them, rather then the out of control federal government.

Humans are funny. Why do we think we are so much more important than any other species in the ecosystem. Preserving "history" of doing anything in any sensitive habitat is completely unimportant to me. Ego, ego, ego... we do not OWN this world!!! To feed humans at all costs is not more important than EVERYTHING.

the 1964 wilderness act was established to protect un-developed lands i'm pretty sure you can't arbitrarily ignore 70 years of active development and use to then call it wilderness land and revoke a lease.
Major issue i have with many of the wilderness land acquisitions over the past umpteen years they ignor that many of the lands have been developed and used. Having roads and buildings that should disqualify the lands from becoming wilderness tracts. instead they just need to be managed by the government not rolled into a vast portfolio of lands no longer being managed but instead left to deteriorate in to poor states of health.
Wilderness has a spot but the parks service was originally developed to manage the land not block all uses. They should have to derive all thier revenue from the management of these lands instead of feeding off the tax dollars that would force them to be more flexible in thier practices
